TERMS AND CONDITIONS OF USE

Preamble

These general terms of use (“GTU”) govern the use of the SOS Universal mobile application (hereinafter referred to as the “Application”), developed by DATASLATITUDES (hereinafter referred to as the “Publisher”). The Application is designed in particular to allow alerts to be sent to predefined contacts in case of an emergency or for any other reason defined by the user.

By downloading, installing, or using the Application, you unreservedly accept these Terms of Use. If you do not accept these terms, you must not use the Application.

1. Service description

SOS Universal allows the user to trigger alerts that are sent, as a phone call or SMS, to contacts who can be from their smartphone’s address book. The service includes the following features:

  • Emergency contact management: contact creation, contact import from phone, contact prioritization, and notification of their emergency contact status. It is possible to temporarily deactivate a contact from the alert list.
    NB: In order to comply with regulations in force in many countries, official emergency service numbers (e.g., 17, 18, 112, 911, etc.) are prohibited.
  • Definition of alert content: the alert can be defined by a phone call and the sending of an SMS which may contain (in addition to the message text) the geographical location (link to a Google Maps or OpenStreetMap map) as well as the corresponding address. This alert can also trigger an audio recording as well as an audible alarm or the simulation of an incoming phone call. The SMS text can be supplemented with an additional message.
  • Sending alerts: alert triggering is done in three modes:
    • Immediate Mode: the alert is sent instantly after triggering via the SOS button.
    • Deferred Mode: the alert is sent after a user-defined delay.
    • Repetitive Mode: the alert is sent after an initial delay, then repeated at regular intervals over a defined period.
  • Settings: the language of SOS Universal (54 languages are available) as well as the visual theme (light or dark) can be configured. It is also possible to make various settings related to the alarm trigger (5-second delay in immediate mode, display or not of the “SOS” text on the alert button and possible emission of a vibration before sending the alert). The settings also allow automatic triggering of the alert from an application widget, directly from the smartphone’s home screen. Regarding the choice of sound alarm, six siren recordings and four human scream recordings are offered.
  • History: The Application keeps a history of the last 50 alerts sent, with all relevant information: name of the alerted contact, date, time, message content, and alert mode used.
  • Audio recording management: it is possible to store up to 200 audio recordings in the smartphone’s download directory. Each recording is timestamped and can be listened to, renamed, or deleted.


For users with cognitive impairments, the Application can be configured by a trusted third party and then locked. In this mode, only the main alert trigger button is active (as well as the alert cancellation button). Unlocking is done simply with code 0000.

Apart from triggering an alert, three additional utilities are available, each of which can be configured with an optional trigger delay:

  • audio recording,
  • sound alarm,
  • simulated incoming phone call.

2. User obligations and responsibilities

By using the Application, you agree to:

  • Provide accurate information: you are solely responsible for the accuracy of the information provided, particularly the phone numbers of emergency contacts.
  • Obtain consent from your contacts: it is your responsibility to inform and obtain the explicit or implicit consent of your contacts to be included in your emergency list and to receive alerts from you. The Publisher disclaims all responsibility in case of non-compliance with this obligation.
  • Use the Application responsibly: The Application is intended for use in case of need for assistance or emergency. Abusive use, spreading false alerts, or harassing your contacts is strictly prohibited.
  • Comply with applicable laws: the use of the Application must comply with applicable laws and regulations, particularly concerning personal data protection (GDPR in Europe), respect for privacy, and message dissemination.

It is also the user’s responsibility to check with their mobile service provider that the terms of use of their subscription allow them to make phone calls or send SMS according to the frequency they have chosen (especially when repetitive mode is chosen).
The Publisher disclaims all responsibility in case of restriction or suspension of the user’s subscription.

3. Personal data and privacy

3.1. Data collection and processing

The Application uses the following data; all are exclusively stored on your device:

  • Contact data: the phone numbers and names of your contacts that you create or choose to import into the Application. This data is stored on your device and is not transferred to the Publisher’s servers.
  • Location data: when you enable location sending, the Application accesses your smartphone’s geolocation data.
  • Audio recordings: if you use the recording function, audio files are created and stored on your device.
  • Alert history: this history is also stored locally on your device.

3.2. Data usage

The processed data are used exclusively for the proper functioning of the Application and the sending of alerts. The Publisher undertakes not to access, sell, rent, or share your personal data with third parties.

3.3. Required permissions

To function correctly, the Application will require access to your smartphone’s permissions, such as access to contacts, geolocation, microphone, audio recording, storage, notifications, and SMS/phone functions. By using the Application, you agree to provide these permissions.

4. Limitation of liability

The Publisher strives to ensure the proper functioning of the Application but cannot guarantee uninterrupted or fault-free service. By using the Application, you accept the possible occurrence of the following unforeseen events:

  • Network dependence: the sending of alerts depends on the availability of your mobile network and that of your contacts. The Publisher cannot be held responsible for delays or failures in SMS or call delivery.
  • Geolocation accuracy: The accuracy of geolocation depends on your device’s technology (GPS, Wi-Fi, etc.) and the environment. The Publisher does not guarantee absolute accuracy.
  • Data loss: The Publisher cannot be held responsible for any loss of data or contacts due to a failure of the Application or your device.
  • Security: although the Publisher implements reasonable security measures, it cannot guarantee absolute protection against any intrusion, hacking, or fraudulent use of the Application.

5. Intellectual property

The Application and this Website, their content (texts, images, icons, source code) and all its features are the exclusive property of the Publisher and are protected by intellectual property laws. Any unauthorised reproduction, distribution, or use is strictly prohibited.

6. GTU modification

The Publisher reserves the right to modify these General Terms of Use at any time. Continued use of the Application after the publication of modifications constitutes acceptance of the new GTC.
